Terms & Conditions for Employees

Effective Date: January 4, 2025

These Terms & Conditions (“Terms”) apply to employees, staff members, or independent contractors (“Employee,” “you,” or “your”) who are invited by a business or organization (“Employer”) to use the ShiftNinja platform.

By creating an account or accessing ShiftNinja, you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. Access Provided by Employer

Your Employer controls your access to ShiftNinja, including account creation, permissions, and removal.

If your Employer cancels their ShiftNinja account or removes you from their organization, your user account and associated data may be suspended or permanently deleted.

2. No Direct Charges to Employees

Employees are never billed directly by ShiftNinja.

All fees, subscriptions, and payment obligations rest solely with your Employer.

3. Permitted Use

You may use ShiftNinja only for lawful, employment-related purposes, including:

  • Viewing work schedules and assigned shifts
  • Clocking in and out of shifts
  • Submitting time-off or availability requests
  • Communicating with your Employer or team members

You agree not to misuse the platform, submit false information, or engage in unlawful, offensive, abusive, or disruptive behavior.

4. Data Collected & Shared with Employer

By using ShiftNinja, you understand that the following data may be collected and made accessible to your Employer:

  • Work schedules, shift confirmations, and availability
  • Clock-in and clock-out times
  • Geofenced location data (where enabled)
  • Training and certification records (including LIQUORexam integrations, if applicable)
  • Messages and in-app communications

5. Privacy & Data Ownership

Your Employer controls your employment-related data within ShiftNinja.

Requests to correct, export, or delete data should be directed to your Employer.

ShiftNinja processes and stores data solely to provide the Services and does not sell Employee personal information.

6. Account Termination

If your Employer cancels their ShiftNinja account, your user account and associated data may be permanently deleted.

Employees requesting account deletion should contact their Employer directly.

7. ShiftNinja’s Role

ShiftNinja is a software platform and is not your Employer.

ShiftNinja does not set wages, pay rates, work hours, or employment conditions, and does not provide payroll or HR services.

8. Limitation of Liability

ShiftNinja is provided “as-is” and “as-available.”

We are not responsible for payroll errors, scheduling decisions, or disputes between you and your Employer.

9. Modifications

ShiftNinja may update these Terms at any time. Continued use of the platform after updates constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States.
