Terms & Conditions For Employee

These Terms & Conditions (“Terms”) apply to employees, staff, or contractors (“Employee,” “you,” or “your”) who are invited by a business to use ShiftNinja. By creating an account, you agree to these Terms.

1. Access Provided by Employer

  • Your employer or organization (“Employer”) controls your access to ShiftNinja.
  • If your Employer cancels their account or removes you, your account may be permanently deleted.

2. No Direct Charges

  • Employees will never be billed directly by ShiftNinja.
  • All billing and payment responsibilities rest with your Employer.

3. Permitted Use

  • You may use ShiftNinja only for lawful employment-related purposes, such as viewing schedules, clocking in/out, messaging your team, and submitting time-off requests.
  • You agree not to misuse the platform or provide false information.

4. Data Collected

By using ShiftNinja, you understand that the following data may be collected and shared with your Employer:

  • Work schedules, shift confirmations, and time-off requests.
  • Clock-in/clock-out times, including geofenced location data.
  • Certifications and training records (if synced with LIQUORexam).
  • Messaging and communication within the platform.

5. Privacy & Data Ownership

  • Your Employer controls your data in ShiftNinja.
  • If you need data corrected or deleted, contact your Employer.
  • ShiftNinja may store and process your data to provide services, but we do not sell your personal information.

6. Account Termination

  • If your Employer cancels their ShiftNinja account, your User account and associated data may be permanently deleted.
  • You may request deletion of your account directly by contacting your Employer.

7. ShiftNinja’s Role

  • ShiftNinja is not your Employer.
  • We do not set your wages, hours, or conditions of employment.
  • Any employment disputes must be resolved directly with your Employer.

8. Limitation of Liability

  • ShiftNinja provides the platform “as-is.”
  • We are not responsible for payroll errors, scheduling decisions, or disputes with your Employer.

9. Modifications

ShiftNinja may update these Terms at any time. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States.
