Terms & Conditions For Businesses

These Terms & Conditions (“Terms”) govern your use of ShiftNinja’s services if you are a business or organization that creates and manages a ShiftNinja account.

By creating a ShiftNinja business account, you (“Customer,” “Business,” “you,” or “your”) agree to these Terms.


1. Services Provided

ShiftNinja provides scheduling, time tracking, compliance, and communication software for businesses. Features may include, but are not limited to: employee scheduling, geofenced clock-in/clock-out, labor law compliance tools, LIQUORexam training integration, team messaging, and analytics.

2. Account Ownership & Responsibility

  • You are responsible for all activity under your account, including your employees, contractors, and managers (“Users”).

  • You agree to only add Users who are lawfully employed or contracted by your business.

  • You are responsible for ensuring schedules, payroll exports, and compliance settings are accurate and lawful.

3. Billing & Payments

  • Free Plan: Businesses with 10 or fewer Users may use ShiftNinja free of charge.

  • Standard Plan: For businesses with 11 or more Users, pricing is $1 per User per month.

  • Corporate Accounts: LIQUORexam.com corporate accounts receive ShiftNinja free, with unlimited Users.

  • Payments are billed monthly on a recurring basis.

  • All fees are non-refundable once charged.

4. Cancellations & Termination

  • You may cancel your account at any time from your admin settings.

  • Upon cancellation:

    • Your account will be deactivated at the end of the current billing cycle.

    • All Users associated with your account may be permanently deleted from our system.

  • ShiftNinja may suspend or terminate accounts for non-payment, misuse, or violations of these Terms.

5. Data Use & Privacy

  • You retain ownership of all data you input into ShiftNinja, including schedules, employee information, and time records.

  • By using ShiftNinja, you grant us a license to process, store, and transmit data as necessary to provide the service.

  • You are solely responsible for obtaining any required consents from your employees to use their data within ShiftNinja.

6. Employee Management

  • You agree not to use ShiftNinja in violation of local, state, or federal labor laws.

  • ShiftNinja provides tools (such as break enforcement, role restrictions, and overtime alerts) but final compliance responsibility rests with your business.

7. Limitation of Liability

  • ShiftNinja provides software “as-is” without warranty.

  • We are not responsible for:

    • Errors in payroll, scheduling, or compliance arising from your use of the software.

    • Employment disputes between you and your employees.

  • Our total liability for any claim shall not exceed the amount paid by you in the 3 months prior to the claim.

8. Indemnification

You agree to indemnify and hold ShiftNinja harmless against any claims, damages, or liabilities arising out of your business’s use of the platform, including but not limited to wage disputes, compliance failures, or employment-related claims.

9. Modifications

ShiftNinja may update these Terms at any time. Continued use after changes constitutes acceptance.

10. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States.
